Since a lot of people use Instant Replay, and it doesn't cover you if you're getting reported, there should be a rule to the fact that someone should have to say if they are actually reporting you so you have time to save the Replay, instead of being reported an hour later without knowing and having no way to defend yourself.

But you would have no way of knowing if they are gonna report you, causing you to not save and having no way to back yourself up

If you think it might be a sketchy situation, then record. If you follow the rules then you shouldn't have anything to worry about. Also, if they do record and report but it isn't a rule violation you will be fine. As stated, just make sure you initiate properly, and if you feel that what you did might look questionable to the other party hit the record button.

Assume every time you do something sketchy they are going to report you or just dont do anything sketchy at all, i get threatened every day to get reported by ppl who are red named ppl who got texted and didnt comply usually when someone feels like u rdm'd them or something they will cry about it in side chat.

is it possible for someone to make it look like a rule was broken when it wasn't though? just curios.

OBS is fantastic, and doesn't use a ton of hard drive space. Players have to report you within 2 weeks, so just keep a months worth of recordings and record each time you play (if you want to be really safe). 

Alternatively, use ShadowPlay and save your recording when you kill someone. It will use more space than OBS for a 20 minute recording than OBS will for hours of recording, but some players go that route. 

For reference - OBS uses about 1GB/hour (depending on your settings).
